Terms of Service
These Terms of Service ("Terms") govern your access to and use of Studio Score Keeper (the "Service"), operated by Vivariance Inc. ("we," "us," "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
Studio Score Keeper is a web application that helps dance studios plan, schedule, score, and publish results for in-studio events such as team matches, mini-matches, and showcases.
2. Accounts
- You must provide accurate information and keep your login credentials secure. You are responsible for all activity under your account.
- You must be at least 18 years old to create a studio-owner account.
- Day-of participants (teachers, judges, results viewers) access events using PINs and do not create accounts.
3. Your content and data
- You retain ownership of the data you enter — rosters, entries, scores, and results ("Your Content").
- You grant us a limited license to host, process, and display Your Content solely to provide the Service.
- You are responsible for Your Content, including obtaining any consents required to enter information about other people, including minors (see our Privacy Policy).
4. Acceptable use
You agree not to: misuse the Service; attempt to access accounts or data that are not yours; reverse-engineer, overload, or disrupt the Service; upload unlawful, infringing, or harmful content; or use the Service to violate any law or third-party right.
5. Payments and billing
- The Service is billed per event. Current pricing: $49 per unjudged event and $99 per judged event, each including up to 500 entries, with $40 per additional 1,000 entries. The price shown at the time of purchase applies to that event.
- Payments are processed by Stripe; by paying, you also agree to Stripe's terms. We do not store full card details.
- A purchased entry allowance is a ceiling for that event. Deleting entries does not reduce or refund it. At the limit, you must purchase additional capacity to add more entries.
- Coupons and promotion codes may be offered at our discretion.
- Refunds are governed by our Refund Policy.
6. Availability; no warranty
The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted or error-free, or that scoring, tabulation, or results will be free of errors. You are responsible for reviewing results before relying on or publishing them.
7. Limitation of liability
To the maximum extent permitted by law, Vivariance Inc. will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill. Our total liability for any claim arising out of or relating to the Service will not exceed the amount you paid us for the event giving rise to the claim during the 12 months before the claim.
8. Indemnification
You agree to indemnify and hold harmless Vivariance Inc. from any claims, damages, losses, and expenses (including reasonable legal fees) arising from Your Content, your use of the Service, or your violation of these Terms or any law or third-party right.
9. Termination
You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms or for any other lawful reason. Per-event purchases already used are non-refundable on termination, except as stated in the Refund Policy.
10. Changes to these Terms
We may update these Terms from time to time. Material changes will be posted on this page with a new "last updated" date. Your continued use of the Service after changes take effect means you accept the updated Terms.
11. Governing law
These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws rules. The state and federal courts located in New York will have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service.
